We encourage you to read them carefully. Any order confirmation implies express acceptance of these GTC, confirmed by a mandatory checkbox during payment. Special attention is given to customers in the USA and Europe, as well as those using American Express (Amex), with clauses adapted to the Fair Credit Billing Act (FCBA) in the USA, the PSD2/3 and GDPR directives in Europe, and the Amex Merchant Regulations.

- Products and Orders: Our products are presented with the utmost care and are subject to availability. Photos and descriptions are not contractual but are as accurate as possible to avoid any ambiguity, in accordance with FCBA transparency requirements in the USA and PSD2 in Europe. Placing an order implies acceptance of the prices and descriptions of the items. If you have any doubts about conformity, please contact us before purchasing.
- Prices and Payment: Prices are displayed in [currency] and include VAT. Shipping costs are calculated at checkout. Payments are processed through Shopify Payments with secure authentication (3D Secure/SCA for Europe and Amex, FCBA compliance for the USA). You agree that all transactions are final once confirmed, unless you exercise your right of withdrawal. For customers in the USA, Europe, or using Amex, you acknowledge the specific rules (60-120 day time limit for disputes under FCBA/Amex) and agree to contact us beforehand for resolution; failure to comply may result in a €50 administrative fee and automatic dispute resolution.
- Shipping: We ship worldwide via tracked letter, a secure delivery method that does not require a signature upon receipt. Delivery times are estimates and may vary. Collabswatch.com cannot be held responsible for delays caused by the carriers. Delivery is confirmed by the provided tracking number, with an electronic status of "delivered" or "dropped" by the carrier, conforming to Amex, FCBA (USA), and PSD2 (Europe) standards. For customers in the USA, Europe, or using Amex, the "delivered" tracking status constitutes acceptance of delivery. Any claim for non-receipt must be made within 48 hours of the delivery notification (aligned with Amex/FCBA timelines of 20-60 days for responses); beyond this timeframe, it will be considered inadmissible. Provide evidence (photos, etc.) for any dispute.
- Right of Withdrawal and Returns: In accordance with applicable law (including FCBA for US customers with a 60-day dispute period, EU directives for Europe with a minimum of 14 days, and Amex rules for chargebacks), you have 14 days (Europe/Amex) or 60 days (USA) to exercise your right of withdrawal or report a non-conformity. Items must be returned in perfect condition, in their original packaging. Return shipping costs are the responsibility of the customer, unless the error is ours. For any non-conformity, contact us within 7 days of receipt with photos/video proving the defect, especially for transactions in the USA, Europe, or Amex where "non-conforming" disputes require strong evidence (Amex/FCBA Merchant Regulations). A return is mandatory for inspection; without return within 14 days (Europe/Amex) or 30 days (USA), no refund will be issued. Any CB/chargeback dispute not respecting this procedure will be contested as abusive, with reference to the Amex categories ("Cardmember Disputes" or "Fraud") or FCBA.
- Warranty and Liability: Products are covered by the legal warranty of conformity and the warranty against hidden defects. Collabswatch.com cannot be held responsible for misuse of the items. In case of a problem, follow the return procedure above before taking any external action, especially for customers in the USA, Europe, or Amex where chargebacks for "Processing Errors" or "Authorization" are common (according to Amex/FCBA guidelines).
- Data Protection We collect and use your personal data in accordance with our Privacy Policy, and in compliance with US laws (such as CCPA for California residents), EU (GDPR for Europe), in particular for the processing of data in disputes for customers in the USA, Europe or Amex.
- Intellectual Property All site content (texts, images, logos) is the property of Collabswatch.com and may not be reproduced without permission.
- Disputes and Applicable Law These Terms and Conditions are governed by the laws of the United Arab Emirates. In the event of a dispute, an amicable solution will be sought before any legal action is taken. For customers in the USA, any dispute will be submitted to arbitration under the rules of the American Arbitration Association (AAA) in Dubai. For customers in Europe or using Amex, disputes will be handled in accordance with PSD2/3 and the Amex Regulations, with possible arbitration in Dubai. For abusive chargebacks, we reserve the right to prosecute for fraud or abuse of rights and to charge a fee.
- Changes to the Terms and Conditions of Sale and Use: We reserve the right to modify these terms at any time. Modifications will be applicable as soon as they are published on the website.

Chargebacks and Payment Disputes: All chargebacks (chargebacks on credit card payments) must be preceded by contacting our customer service department at hello@collabswatch.com for an attempt at amicable resolution. This is particularly mandatory for customers in the USA (under FCBA), Europe (under PSD2/3), and those using Amex (120-day dispute resolution period). You agree not to initiate a chargeback without first giving us an opportunity to correct the problem (e.g., refund, exchange). In case of violation:
- We will systematically contest the objection with the bank/Amex with all available evidence (tracking "delivered", logs of acceptance of the terms and conditions, communications).
- An administrative fee of €50 may be charged for abusive processing.
- For repeated or fraudulent activity, we may block your account and report the incident to the appropriate authorities (e.g., the FTC in the US, EU authorities). This clause aims to discourage abuse while respecting your legal rights under FCBA, PSD2/3, and Amex.
